1. Laws and Regulations

Formalities upon arriving / leaving Montenegro

A Master of a foreign flagged yacht entering Republican waters is required to proceed first to a designated port of entry opened for international traffic for clearance, vignette and crew and passengers list inspection by Harbor Master.

All yachts must check in at the Q dock and then go to their assigned berth in Marina.

It is required by Montenegrin Law for foreign yachts to have a vignette (navigation permit) while sailing in national waters of Montenegro. Vignette must be displayed on a prominent position.

Validity period of a vignette is up to one year from the date on which it was issued.

Vignette serves as a proof of evidence that a foreign yacht:

  • has registered its entry into Republican waters;
  • has a valid Certificate of Registry;
  • has a master and crew members that are qualified for steering the yacht in accordance with the regulations of the yacht’s flag state, such regulations being in compliance with the STCW Convention and/or Republican regulations;
  • has valid insurance cover against damage caused to third parties.
  • proof of ownership or authorization for use;
  • that the fee payable for marine safety objects and administrative fees are settled.

The Harbor Master’s office or its branch office will issue a vignette based on the following documentation:

  • Crew and/or passengers list
  • Certificate of Registry
  • Crew’s Certificates of Competency for desired crew rank
  • Valid Yacht insurance that covers all watertoys and tenders that will be used at Montenegrin water
  • Proof of the ownership for vessel, or a Captain’s Power of Attorney

Prior to leaving Republic of  Montenegro , the Agent of the yacht must undertake the following:

• undergo the border control (police and customs)

• endorse a crew and passenger list in the Harbormaster’s office or Branch office

A yacht must use the shortest way to leave Montenegro immediately after completing the clearance out. Once the clearance out is done, the yacht is forbidden to stop in Montenegro, except for Force Mayor. In this case, the yacht has to contact the Agent immediately.

 Vignette

Price of a vignette depends on a boat length and issuing period:

For vignette issuing you will need following documents:

  • - Crew and/or passengers list
  • - Certificate of the Vessel Ability for Navigation
  • - Certificates of competency for desired crew rank
  • - Insurance data for a sailing in accordance with the Flag-State regulations
  • - Proof of the ownership for vessel, or a Captain’s Power of Attorney

Animals onboard:

Animals on board require health certificate issued by the relevant institution in the domicile state of the animal’s owner.

Visa regime

The following nationals may enter and stay within the territory of Montenegro up to 90 days on the basis of a valid travel document:

Andorra, Australia, Austria, Belgium, Bosnia and Herzegovina, Canada, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, Former Yugoslav Republic of Macedonia, France, Germany, Greece, Hungary, Ireland, Island, Israel, Italy, Korea, Latvia, Lichtenstein, Lithuania, Luxembourg, Malta, Monaco, Netherlands, New Zealand, Norway, Poland, Portugal, San Marino, Singapore, Slovak Republic, Slovenia, Spain, Sweden, Switzerland, United Kingdom of Great Britain, United States of America, Vatican.

The following nationals may enter and stay in Montenegro for period of 30 days.

Albania, Russian Federation, Turkey, Ukraine

Holders of travel documents containing a valid Schengen visa, a valid visa of the United States of America or a permission to stay in these countries, may enter and stay, i.e. pass through the territory of Montenegro up to seven days, and not longer than the expiry of visa, if the period of validity of visa is less than seven days.

Crew with no visa will be issued shore-pass valid up to one month.

Penalties in case of misconduct with Rules and regulations:

Legal entity shall be penalized with the penalty 10 times to 300 times higher than the minimal salary in Montenegro for the following offences:

  • if a person fails to inscribe a yacht into the Register and does not hoist the flag of the Republic
  • does not hoist the Republican flag
  • fails to write the name and the marks on the surface of the yacht
  • is not in a possession of the international marks, calling sign, name, MMS and the number
  • fails to inspect the yacht in the prescribed period
  • fails to inform Administrative Body that the yacht has been damaged
  • fails to use proceed first to a designated port of entry
  • fails to leave the Republic on route and in time prescribed by Harbor Master or Harbor Master`s office
  • the yacht is not reported to the Harbor Master
  • Prior to sailing in Republican waters it fails to obtain a vignette or fails to verify the crew list or the passenger list
  • does not have crew and passenger list, fail to verify such list or if the yacht is inhabited with a passenger who is not on the list of crew and passengers
  • fails to provide pilot for a yacht weighing more than 1000 gt
  • Pollutes sea or the environment, lacks the equipment and storage space for protection of the sea
  • Fails to keep the records or verify the list of crew and the passengers with the Harbor Master or if the verified crew and passenger list is not kept on the yacht.
